Candidate Terms and Consent

These Candidate Terms and Consent (“Candidate Terms”) constitute a legally binding agreement between Fast Hiring LLC, doing business as FastHiring (“FastHiring,” “we,” “our,” or “us”), and any individual who accesses the FastHiring platform or participates in a hiring process through the platform (“Candidate,” “you,” or “your”).

By registering for, accessing, or participating in any interview, application, or hiring workflow through the platform, you acknowledge that you have read, understood, and agree to be bound by these Candidate Terms and our Privacy Policy, available at fasthiring.ai/privacy, which is incorporated herein by reference.

You must be at least 18 years of age to use this platform. By registering, you represent that you are at least 18 years old. If you are between 14 and 17 years of age and are applying for a role for which you are legally eligible to work, you may only use the platform with the consent of a parent or legal guardian.

I. PURPOSE OF THE PLATFORM AND FASTHIRING’S ROLE

FastHiring provides a technology platform that enables hiring organizations — including employers, recruiters, staffing agencies, and other talent acquisition professionals — to manage hiring workflows and connect with candidates for specific job opportunities. FastHiring is not an employer, staffing agency, recruiter, or hiring decision-maker. FastHiring does not evaluate candidates, determine eligibility for employment, or make hiring decisions. All hiring decisions are made solely by the hiring organization using the platform.

FastHiring sends email and, where you have provided consent, SMS communications to you on behalf of the hiring organization associated with your session. These communications are sent using FastHiring-managed infrastructure but originate from and are authorized by the hiring organization. FastHiring acts as a technology intermediary and is not responsible for the content or outcome of those communications.

FastHiring processes your personal information as a service provider and processor (as applicable under relevant law) acting on behalf of the hiring organization. The hiring organization is the data controller responsible for your candidate data and for the lawfulness of your inclusion in their hiring process. FastHiring does not use artificial intelligence, automated scoring, or algorithmic ranking to evaluate candidates. All candidate evaluation is conducted by human interviewers employed or engaged by the hiring organization. FastHiring does not extract, store, or analyze biometric identifiers — including voiceprints, facial geometry, or retina scans — from audio or video streams transmitted through the platform. Video and audio are transmitted between participants using peer-to-peer or relay connections and are not retained by FastHiring.

II. ELIGIBILITY AND VOLUNTARY PARTICIPATION

Your participation in any hiring process facilitated through the platform is entirely voluntary. You may choose whether to register for, participate in, or withdraw from any interview or hiring activity at any time without penalty.

FastHiring requires each hiring organization to represent and warrant that it has a lawful basis to contact you regarding this employment opportunity before uploading your information. If you did not expect to be contacted or believe you were contacted in error, please do not complete registration and contact support@fasthiring.ai.

FastHiring does not guarantee that you will receive an interview, job offer, or any follow-up communication from a hiring organization.

III. THE REGISTRATION AND HIRING PROCESS

When you access a FastHiring hiring session invitation, the following process applies:

(a) You will be presented with information about the role and, where the hiring organization has chosen to display it, the organization’s name and company information.

(b) You will be asked to provide your first and last name, email address, and phone number. You represent and warrant that all information you provide is accurate, complete, and truthful.

(c) The hiring organization may have configured prescreening or qualification questions specific to this role. These questions are set solely by the hiring organization based on job-related criteria. Prescreening qualification filtering is a rule-based pass/fail check configured by the hiring organization — it is not AI, algorithmic scoring, or a predictive model. The hiring organization is solely responsible for ensuring their prescreening criteria comply with applicable laws. If your answers indicate you do not meet the minimum qualifications, you will receive a clear notification that you do not qualify for this particular opportunity. This is the hiring organization’s determination, not FastHiring’s.

(d) If you meet the qualification criteria, you will be invited to select an available interview time slot.

(e) You will receive an email confirmation of your interview time. Your interview access link will be delivered in reminder communications in advance of your scheduled interview.

FastHiring requires hiring organizations to warrant that all job postings reflect bona fide employment opportunities. However, FastHiring does not independently verify individual job postings.

IV. INFORMATION YOU PROVIDE

You represent and warrant that all information you provide through the platform is accurate, complete, and truthful, and that you have the legal right to provide such information.

FastHiring also collects technical information necessary to deliver the service, including your IP address, browser type, and timezone. For full details see our Privacy Policy at fasthiring.ai/privacy.

Your information will be made available to the hiring organization associated with the specific hiring process for which you have registered. Your information is used solely to facilitate that hiring workflow. FastHiring does not sell your personal information and does not use your information for advertising or independent marketing purposes.

V. COMMUNICATIONS

Email Communications. FastHiring sends transactional email communications necessary to deliver the Service, including your interview confirmation and interview access link. Because these communications are required for you to participate in your scheduled interview, they are not subject to marketing opt-out requests. If you no longer wish to receive communications, you may withdraw from the hiring process at any time by contacting support@fasthiring.ai. Emails sent through the platform will identify both FastHiring and the hiring organization, and will include FastHiring’s physical mailing address as required by applicable law.

SMS/Text Message Communications — Separate Consent Required. FastHiring will request your separate, explicit consent to receive SMS text message reminders about your interview at the time you provide your phone number during registration. This consent is presented as a clearly labeled, unchecked opt-in checkbox. Your consent to SMS is not required to register for or participate in the hiring process.

To opt out of SMS at any time, reply STOP to any text message you receive, or contact support@fasthiring.ai. FastHiring will process opt-out requests promptly in accordance with applicable law.

FastHiring is not responsible for communications hiring organizations send to you through external channels outside the platform. If you experience unwanted contact, contact support@fasthiring.ai.

VI. YOUR PRIVACY RIGHTS

Your personal information is handled in accordance with the FastHiring Privacy Policy at fasthiring.ai/privacy. Depending on your state of residence, you may have rights to access, correct, delete, or obtain a copy of your personal information in a structured, machine-readable format, or to opt out of certain processing. Contact privacy@fasthiring.ai or visit fasthiring.ai/privacy for details on your rights and how to exercise them.

VII. INTERVIEW PARTICIPATION AND TECHNOLOGY

The platform facilitates live audio and video interviews using self-hosted video infrastructure. FastHiring does not currently provide end-user-facing recording functionality and does not store the audio or video content of interviews. If recording functionality is introduced in the future, FastHiring will implement notice and consent mechanisms that comply with applicable federal, state, and local recording consent laws, including all-party consent requirements, before any such feature becomes available.

FastHiring does not use AI to analyze your video, audio, facial expressions, or voice patterns during interviews. If you have questions about whether the hiring organization uses AI analysis tools, contact them directly.

You are responsible for ensuring you have the necessary technology and connectivity to participate. FastHiring is not responsible for technical issues or connectivity failures outside its control.

VIII. ACCESSIBILITY

FastHiring is committed to platform accessibility. If you need an accommodation to access or participate in the platform, contact support@fasthiring.ai with “Accessibility” in the subject line. For accommodations related to the interview itself, contact the hiring organization directly.

IX. HIRING ORGANIZATION RESPONSIBILITY AND YOUR RIGHTS

Hiring organizations are solely responsible for job postings, screening criteria, interview conduct, and hiring decisions. FastHiring does not control or participate in hiring organization conduct. Questions or disputes about a job opportunity, interview, or hiring decision should be directed to the hiring organization.

If you believe a hiring organization has engaged in discriminatory, harassing, or unlawful conduct through the platform, you may report it to FastHiring at support@fasthiring.ai with “Employer Complaint” in the subject line. FastHiring may, in its discretion, investigate and take action including warning the hiring organization, restricting their platform access, or suspending their account.

If a hiring organization conducts a background check in connection with your application, that process is conducted solely by the hiring organization. FastHiring has no involvement in background check processes.

X. ACCEPTABLE USE

You agree not to provide false, misleading, or fraudulent information, and not to misuse the platform or attempt to gain unauthorized access to systems or data. FastHiring reserves the right to restrict or terminate your access in cases of suspected misuse, misrepresentation, or disruptive behavior.

XI. NO EMPLOYMENT RELATIONSHIP

You are not an employee, contractor, or representative of FastHiring. FastHiring does not represent any hiring organization. Any employment relationship that may arise is solely between you and the hiring organization.

XII. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” FASTHIRING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FASTHIRING DOES NOT GUARANTEE ANY EMPLOYMENT OPPORTUNITY, INTERVIEW EXPERIENCE, OR PLATFORM PERFORMANCE.

XIII. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTHIRING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING WITHOUT LIMITATION DAMAGES RELATED TO HIRING ORGANIZATION CONDUCT, HIRING DECISIONS, FAILURE TO RECEIVE EMPLOYMENT, OR LOSS OF OPPORTUNITY. FASTHIRING’S TOTAL AGGREGATE LIABILITY TO YOU FOR DIRECT DAMAGES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THIS LIMITATION DOES NOT APPLY TO: (I) LIABILITY ARISING FROM FASTHIRING’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; OR (II) CLAIMS ARISING FROM FASTHIRING’S BREACH OF ITS DATA SECURITY OBLIGATIONS OR A CONFIRMED SECURITY INCIDENT INVOLVING YOUR PERSONAL INFORMATION.

XIV. TERMINATION OF ACCESS

FastHiring may suspend or terminate your access if your use violates these Terms or creates risk or harm to the platform or its users. FastHiring will provide notice where reasonably practicable. Upon termination, FastHiring will retain your data for one hundred eighty (180) days, during which you may request a copy in a structured, machine-readable format such as JSON. You may request deletion of your data at any time by contacting privacy@fasthiring.ai. Deletion requests will result in removal of your personal information from the platform, except for records that FastHiring is required by law to retain, such as consent records and communication suppression lists.

XV. DISPUTE RESOLUTION

FastHiring encourages you to contact support@fasthiring.ai to resolve concerns before pursuing formal dispute resolution.

For disputes that cannot be resolved informally, FastHiring and you agree to resolve disputes through binding individual arbitration administered by the American Arbitration Association (“AAA”) under AAA Consumer Arbitration Rules. Arbitration shall be conducted remotely unless both parties agree in writing to an in-person proceeding. FastHiring will pay all AAA filing and arbitrator fees, except where the arbitrator determines the claim was brought in bad faith or for an improper purpose.

If 25 or more similar claims are filed against FastHiring within a 60-day period, the parties agree to a bellwether process: (a) AAA will randomly select 10 claims for initial resolution; (b) all remaining claims will be stayed pending resolution of the bellwether cases; (c) the outcomes of the bellwether cases will inform settlement negotiations for the remaining claims. If the parties cannot agree on resolution after the bellwether process, remaining claims will proceed individually.

You may opt out of this arbitration agreement by contacting support@fasthiring.ai within thirty (30) days of first using the platform. Opting out does not affect your other rights under these Terms.

Notwithstanding the foregoing: (a) either party may bring an eligible claim in small claims court in your county of residence; (b) claims under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2022 are excluded and may be brought in court; (c) either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.

ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS. YOU WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

These Candidate Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. This choice of law does not deprive you of the protections afforded by the mandatory consumer protection laws of your state of residence that cannot be waived by contract.

XVI. UPDATES TO THESE TERMS

For material changes to these Terms — including changes to arbitration, data processing, or consent terms — Because the Candidate Terms are presented and must be accepted each time you register for a hiring session, your acceptance of these Terms is refreshed with each new registration. FastHiring will post material updates at fasthiring.ai/candidate-terms. If you have concerns about updated terms, you may decline to register for future sessions. For non-material updates, FastHiring will post updated terms at fasthiring.ai/candidate-terms. Continued use after non-material updates constitutes acceptance.
